Terms and Conditions for SEBI Research Analyst Services
These Terms and Conditions (“Terms”) govern the use of research analyst services provided by FiSC Capital and its Founder Mohammed Shoaib Dayma (INH000015525), a SEBI Registered Research Analyst, licensed and regulated by the Securities and Exchange Board of India (SEBI). By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the services.
Scope of Services
a. The Provider offers research analyst services in accordance with SEBI regulations.
b. Services may include analysis, reports, recommendations, and other relevant information pertaining to securities and financial markets.
Client Eligibility
a. Clients must be individuals or entities eligible to receive research analyst services as per SEBI guidelines.
b. Clients are responsible for ensuring compliance with all applicable laws and regulations.
Research Analyst Disclosure
a. The Provider and its analysts will disclose any potential conflicts of interest, including financial interests in recommended securities.
b. Recommendations are based on unbiased analysis, but clients should conduct their own research and seek professional advice as needed.
Subscription and Payment
a. Clients may subscribe to the Provider’s services based on available subscription plans.
b. Payment terms, including subscription fees, are outlined in the respective subscription plan.
c. Payments are due in advance and are non-refundable.
d. Non payments will lead to blacklisting of clients and legal actions will be taken against them.
Use of Information
a. Research reports and recommendations provided by the Provider are for informational purposes only and should not be considered as investment advice.
b. Clients are solely responsible for their investment decisions and actions taken based on the information provided.
Confidentiality
a. The Provider will maintain the confidentiality of client information in accordance with applicable laws and regulations.
b. Clients should not disclose any confidential information obtained through the services without prior consent from the Provider.
Client Records
a. The Company will maintain client-wise records as mandated by SEBI regulations, including:
- KYC documents (PAN and Aadhar
- Investment advice provided
- Analysis reports
- Rationale for recommendations
- Related books of accounts
- A register of clients with investment advice dates
Limitation of Liability
a. The Provider shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the services.
b. The Provider’s liability, if any, shall not exceed the amount paid by the client for the services.
Termination
a. Either party may terminate the services at any time with written notice to the other party.
b. Upon termination, clients will no longer have access to the Provider’s research analyst services.
Governing Law and Dispute Resolution
a. These Terms shall be governed by and construed in accordance with the laws of India.
b. Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in accordance with SEBI regulations.
Entire Agreement
These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
Amendments
a. The Provider reserves the right to amend these Terms at any time.
b. Clients will be notified of any amendments, and continued use of the services constitutes acceptance of the amended Terms.
By accessing or using the Provider’s research analyst services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
Waiver
No waiver by either party of any breach of these Terms will be deemed a waiver of any prior or subsequent breach.
